FTC Non-Compete Ban Still Proceeding Despite Court Challenges

On August 14, 2024, a Florida federal judge in the Middle District of Florida ruled that the Federal Trade Commission’s (FTC) proposed ban on most non-compete agreements cannot be enforced. Chief Judge Timothy Corrigan’s opinion held that the FTC lacked the authority to issue a broad non-compete ban. The limited order suggests that the Court’s decision only applies to the employer in the case before the District, not all employers.

This is the second court to rule that the FTC’s non-compete ban is unenforceable.

What does this mean for employers?

Neither of these decisions changes anything for employers. Employers should continue to prepare for the rule to become effective on September 4, 2024.
